An actress who has been a presence on television for more than 40 years–and who twice won the People’s Choice Award as favorite female performer in a new TV series–has prevailed in a Kentucky lawsuit over a failed food business, the AP reported.

Actress and fitness guru Suzanne Somers was sued in connection with Suzanne’s Kitchen, the story says. A Kentucky judge dismissed the case claiming there wasn’t enough evidence to proceed.

Louisville attorney John Shannon Bouchillon had invested $400,000 in the business and brought the suit, claiming he was misled. Somers testified that even though her likeness and name were used to promote the business, she had nothing to do with running it. The company was reportedly run by former Kentucky Gov. John Y. Brown, who was dropped from the suit before it went to trial, the story reports.

Somers, best known for the 1980s sitcom "Three’s Company" as well as her successful exercise and diet products, said that she felt vindicated by the judge’s decision.
