A former NBC and WB television executive has filed a motion to dismiss a sexual abuse lawsuit. The Los Angeles Times reports that Garth Ancier, the former president of NBC Entertainment, filed the motion Thursday.

The lawsuit was filed in April by Michael Egan, who claims he was abused by Ancier both in Hawaii and at an estate in Encino, Calif. Egan also accused “X-Men” director Bryan Singer, as well as entertainment executives David Neuman and Gary Goddard, of abuse.

The story reports: “In the motion filed on Thursday, Ancier asked the court to dismiss the case, saying the court lacks jurisdiction because Ancier was not in Hawaii at the time the alleged abuse took place.”

The report adds: “As evidence, the motion uses three declarations from third parties to show that Ancier was not in Hawaii at the time. It also uses testimony from Egan himself in a 2000 case against other defendants in which he says he didn't go on trips outside the continental United States.”

Ancier’s move comes after Neuman, Singer and Goddard also filed motions to dismiss.

Egan’s attorney told the publication: “I do have a response, but I am restricted in that I can only talk about what is in the court record. Many of the things being reported are being taken out of context or you’re only hearing one side of the story. At the appropriate time and in the appropriate venue, we will respond."
