Tracy Morgan Sues Walmart

Actor and comedian Tracy Morgan has filed a lawsuit against Walmart Stores, alleging the company was partly responsible for the crash that left him seriously injured and killed comedian James McNair, reports The New York Times.

The lawsuit was filed Thursday, a month after the accident, in which a Walmart truck hit the luxury van that was carrying Morgan, McNair and other passengers.

The lawsuit claims Walmart was negligent in the operation and ownership of its truck. Prosecutors have charged the truck’s driver, Kevin Roper, with vehicular homicide, alleging he hadn’t slept in more than 24 hours. Roper has pleaded not guilty.

“As a result of Walmart’s gross, reckless, willful, wanton, and intentional conduct, it should be appropriately punished with the imposition of punitive damages,” the lawsuit states.

On Saturday Morgan left a rehabilitation center where he was recovering from his injuries, which included a broken leg and broken ribs.
