CBS today claimed victory in a lawsuit brought by Dan Rather, who had alleged that the network had interfered with a 2006 “60 Minutes II” story about President Bush’s military service. Mr. Rather left CBS News after the report was discredited.
A decision handed down today by the New York Supreme Court dismisses the majority of the claims filed by Dan Rather against CBS in Sept. 2007, including allegations of fraud, wrongly interfering with business relations and breach of good faith.
Mr. Rather had sought $70 million from his former network and its parent Viacom. The suit also named CBS President and CEO Leslie Moonves, Viacom Chairman Sumner Redstone and former CBS News President Andrew Heyward.
Among the claims dismissed per CBS’s request was Mr. Rather’s assertion that the networks alleged interference with his broadcast was politically motivated.
“We are gratified that the court has dismissed the majority of Mr. Rather’s claims,” CBS said in a statement issued after the decision, “including the spurious claims against Mr. Redstone, Mr. Moonves and Mr. Heyward, as well as the false charges of fraud, tortious interference with prospective business relations, breach of good faith and fair dealing.
The court didn’t rule on some contract claims Mr. Rather brought. CBS said it is confident those counts will be dismissed when the court completes pre-trial discovery.
Mr. Rather couldn’t immediately be reached for comment.

I like Dan Rather and believe in him and his report. He’s always professional. I’m disappointed with the ruling against Mr. Rather. I agree with Mr. Rather’s report and believe that Bush shirked his responsibilities and obligation during his military service. Bush who stands for freedom sidestepped going to battle against the enemy by pulling in his favors from family ties and individuals who weren’t strong enough to stand up to the Bush family for reasons political and otherwise.
Zune and iPod: Most people compare the Zune to the Touch, but after seeing how slim and surprisingly small and light it is, I consider it to be a rather unique hybrid that combines qualities of both the Touch and the Nano. It’s very colorful and lovely OLED screen is slightly smaller than the touch screen, but the player itself feels quite a bit smaller and lighter. It weighs about 2/3 as much, and is noticeably smaller in width and height, while being just a hair thicker.
