A New Jersey judge has agreed to hear a lawsuit brought up against the producers of MTV’s "Jersey Shore" that claims "criminal enterprise" by profiting off of airing fights that cast members on the show deliberately provoked, the Associated Press reports.

Superior Court Judge Joseph L. Foster denied a motion to dismiss the case on Friday. The case is on behalf of three persons seeking restitution after being involved in drunken fights with cast member Ronnie Magro.

MTV was unavailable for comment, according to the AP.
