Florida Court Strikes Down Obama Health Care Reform

A federal judge in Florida today overturned President Obama’s sweeping health care reform measure, CNN.com reported. The move sets up what is expected to be a battle in the U.S. Supreme Court over the reform legislation.

Florida is one of 26 states that filed legal challenges to the measure in an effort to get so-called “Obamacare” thrown out.

“U.S. District Judge Robert Vinson declared unconstitutional the key provision of the Patient Protection and Affordable Care Act–the so-called ‘individual mandate’ requiring most Americans to buy health insurance by 2014 or face penalties. Vinson also declared unconstitutional the section of the act that withholds Medicare funds from states that refuse to participate,” CNN.com reported.

In his ruling, Vinson wrote: "I must reluctantly conclude that Congress exceeded the bounds of its authority in passing the Act with the individual mandate. That is not to say, of course, that Congress is without power to address the problems and inequities in our health care system.”



  1. Not a big fan of the plan but also not a big fan of people choosing not to have healthcare but getting it anyways by sucking off the system.

  2. Harry – the entire point of Obama’s plan was to make it official! he wants all the people without healthcare to be “sucking” of all of us that pay taxes! that is what socialism is. Wake up.

As to how such a development would relate to healthcare services, if you make it too easy for people to access healthcare and too difficult for insurance companies to provide it, you will at the very least, cause a shortage of services. Without the regular balancing mechanism of price and profit, such needing to be free from government interference, you will see those in power assigning the scarce amount of services to selected groups.

  4. Name something that Government has been more successful running than the public sector. Government isn’t designed to run a business. It is designed to govern.

  5. I don’t say the individual mandate is right but how can they require the repeal of the whole bill? There clearly are very good provisions which should be preserved since they are beneficial to ordinary people.

  6. There is a big mess in the united states and I just hope that they fix their problems. If USA will be prosperous so will the whole world.

  7. Many people disagree with Obamacare, until they really need health care and don’t have the means to pay for it.
