A former star of “Lost,” who was involved in a recent incident on a bus in which he was accused of striking the driver during an altercation, will not be charged, reports the AP.

Cleveland prosecutors have decided “after a thorough review of the facts” not to seek an indictment against Matthew Fox, a city spokeswoman announced in a statement, according to the story.

The driver, who will pursue remedies in a civil suit against Fox, was reportedly disappointed because she alleges that Fox was drunk and engaged in "intentional, aggravated felonious assault and battery" as well as causing her emotional distress.

Heather Bormann, the driver, said in her suit that Fox punched her in the breast, groin, arm and legs. In response, she hit him in the head, giving him a bloody lip.

Bormann’s suit is asking for $75,000 minimum for compensatory and punitive damages, the AP reports.
