Lifetime Seeks to Unfreeze ‘Project Runway’

Lifetime filed a new lawsuit in federal court as it seeks to unfreeze “Project Runway,” a series it acquired but is now enjoined from airing by a state court order.
“This is the next step in our dispute with NBCU over the rights to ‘Project Runway,’” the cable channel said in a statement. “ We filed a complaint for declaratory judgment and injunctive relief as a further means of trying to insure that the copyright issues in this dispute are decided by a federal court.”
Lifetime made a deal with the Weinstein Co., which produces the series, to move it and a number of spinoffs from NBC Universal’s Bravo, where it became a cable hit.
NBC Universal filed a suit in state court, claiming it had a right of first refusal that had been breached by the Weinstein Co.
A state court judge found enough merit in NBC Universal’s arguments to grant an injunction that bars Weinstein Co. from promoting, marketing or exhibiting the series until the case is concluded.
Lifetime responded by moving that suit moved to federal court, claiming its copyright on the show is being interfered with. Copyright issues are dealt with in federal court.
In a statement, NBC Universal said, “Lifetime was well aware of NBC Universal’s State Court case the day it was filed and made the decision to wait for several months before seeking to intervene at the 11th hour in the State Court case. Lifetime’s new Federal Court filing is yet another desperate maneuver by them to avoid trying this case in State Court, where NBC Universal has already won a preliminary injunction against The Weinstein Company and where the case was on an expedited track to trial.”
