After a six year patent battle between TiVo and Dish Network, the U.S. Court of Appeals for the Federal Circuit has upheld a lower court’s decision to find Dish Network in contempt for failing to disable DVRs infringing on a TiVo patent, Multichannel News reports.
TiVo stands to collect at least $300 million in damages from Dish Network (formerly EchoStar Communications). TiVo sued Dish in 2004, claiming that Dish’s DVRs infringed on patents held by TiVo. A court in 2006 found in favor in TiVo, and ordered Dish to disable all infringing DVRs.
A federal judge in 2009 found Dish in contempt for failing to follow the court’s disable order.
Dish said it will look for a full review by the Federal Court, and that zero DVR customers will be affected by the decision at this time.
Multichannel estimates that Dish may be required to disable nearly eight million DVRs based on this decision, and could open the door for TiVo to gain a huge amount of leverage in the DVR arena.
The announcement prompted a 50% rise in TiVo stock shares, while Dish dipped 6%.
