Hours before the case was slated to go to trial today, Fox News Channel reached a settlement in a lawsuit focusing on a photo from the 9/11 attacks, Deadline.com reports. FNC had been accused of copyright infringement over its use on Facebook of Thomas Franklin’s photo “Raising the Flag at Ground Zero.”

“According to the Roger Ailes-run cable news giant and North Jersey Media Group, the confidential settlement will ‘discontinue’ all claims, counterclaims and proceedings the parties have had against each other since the latter sued the former and host Jeanine Pirro in October 2013,” Deadline reports.

The report notes that Fox fired back after being sued. “FNC argued fair use in what became a much-watched multi-jurisdictional matter with potentially big social media implications,” Deadline reports.
