A U.S. district judge tossed the $3 million lawsuit that had superstar singer Taylor Swift testifying in court this week that a radio DJ “grabbed my ass underneath my skirt.” The AP reported on Twitter that the defamation suit filed against Swift by David Mueller was thrown out of court.

The judge reportedly determined that Mueller could not prove Swift’s allegations against him got him fired.

But ABC News reports that Judge William Martinez decided to allow Mueller’s claim against Swift’s mother, Andrea Swift, and her radio manager, Frank Bell, to proceed.

Swift’s countersuit against Mueller, in which she is reportedly seeking a symbolic $1 judgment, will also proceed.

The trial is focusing on a 2013 incident that took place in Denver, where Swift says Mueller groped her as they posed for a photo.
